Divorce and legal separation can be classified as equally alike in terms of the process involved. They involve the same procedures like filing for papers and some sorts. You would also expect your personal participation on court trials and other legal proceedings. You would also most likely spend much for both processes.


However, they can be differentiated in the laws they each apply. These laws generally entitle them to be engaged in living separately in all aspects. Generally speaking, divorce and legal separation are acts of dissolving the relationship and terminating the matrimonial bond. In order to differentiate them more concisely, consider the automatic legal separation laws. The laws consist of having the couples separate in terms of living but not totally dissolving the marriage. This is just a simple program which serves as a deciding point to whether they will go through divorce or save the marriage in their own behalf. Automatic legal separation laws are considerably different from divorce laws in terms of division of properties, custody, child support and alimony. In legal separation, the properties are equally divided for each of the couple or couples. Whereas with divorce laws, the court grants a property to the other and the other one is automatically deprived. The court has the final say on the settlement of the couples when they have already been awarded with the divorce decree. On the other hand, automatic legal separation laws give the couple or couples the independence to patch their own mess and if they can not really work things out, they themselves have the final say regarding on property and custody settlements. They make their own agreements on such matters.
