Legal separation laws in some states allow the detection of separation grounds automatically. These grounds are defined by the automatic legal separation laws in selected states. Often, the reason for this is that there is a long time of absence of cohabitation. In some states, legal separation does not automatically leads to divorce. Sometimes, divorce must be filed separately while in other states, the legal separation case can be converted to divorce.

The grounds for legal separation may be cruelty, adultery, imprisonment, and desertion in a specified time like a year. These reasons are included in the so called automatic legal separation laws. Also, these grounds are similar to divorce too. Cruelty is defined as inhuman treatment to the spouse or violence to the children. Adultery, on the other hand, is when the spouse had a lover other than his or her spouse. This is very broad topic that is handled by the courts. Imprisonment or detainment in jail is also another reason. In here, the duties of the spouse can’t be upheld since he or she is in prison. Further, the main reason for most of the legal separation cases is incompatibility. This means that the two parties can no longer understand each other and are not capable of living together anymore.
There are no really automatic legal separation laws in the states but there are articles that state the automatic release of orders when the legal separation case has been decided. Therefore, under the codes of each state, the cases are decided within the jurisdiction of courts.
